By downloading, installing, or accessing the SpotSight mobile application (the "Application"), you signify your agreement to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and SpotSight. If you do not agree to these Terms, you must immediately cease all use of the Application and remove it from your device.
SpotSight provides a crowdsourced information platform intended to assist users in locating parking near various destinations. The services provided include:
The Application is an information tool only. We do not provide parking services, nor do we guarantee the availability, legality, or safety of any parking location identified through the Application.
Users must be at least thirteen (13) years of age to use the Application for informational purposes. The submission of content, including votes, feedback, and new parking locations, is strictly limited to individuals who are at least eighteen (18) years of age. By submitting content, you represent and warrant that you meet this age requirement.
The Application currently operates on an anonymous basis and does not require the creation of user accounts. Users are identified solely via an anonymous device identifier. We reserve the right to introduce optional or mandatory user accounts in the future, subject to updated terms.
When submitting information to the Application, you agree to provide accurate and truthful data. You are prohibited from submitting any content that:
We reserve the right, at our sole discretion, to monitor, review, and remove any user-submitted content without prior notice. Violations of these guidelines may result in the temporary or permanent suspension of your ability to contribute content, or the termination of your access to the Application.
You acknowledge that parking regulations and availability change frequently. You are solely responsible for verifying the legality of your parking by observing all posted signs, meters, and local ordinances. SpotSight shall not be liable for any parking citations, fines, towing fees, or vehicle damage resulting from your reliance on information provided by the Application.
Informational content within the Application is sourced from third parties and anonymous users. We do not independently verify the accuracy of every submission. You acknowledge that data may be outdated, incomplete, or incorrect.
SpotSight retains all rights, title, and interest in and to the Application, including all code, designs, branding, and aggregated data structures.
By submitting content (including votes and feedback) to the Application, you grant SpotSight a perpetual, worldwide, royalty-free, and sublicensable license to use, reproduce, modify, adapt, display, and distribute such content for the purpose of operating and improving the service.
The Application utilizes data provided locally and via APIs from Google (Google Places), OpenStreetMap (ODbL), and Apple (Apple Maps). Usage of these features is subject to the respective terms and privacy policies of those providers.
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SPOTSIGHT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOTSIGHT, ITS AFFILIATES, AND ITS OFFICERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR PROPERTY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APPLICATION.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF FIFTY DOLLARS ($50.00) OR THE AMOUNT PAID BY YOU TO US IN THE PRECEDING TWELVE MONTHS.
You agree to indemnify and hold harmless SpotSight from and against any claims, damages, or expenses (including legal fees) arising from your use of the Application, your violation of these Terms, or your submission of content that infringes upon the rights of a third party.
We reserve the right to terminate or suspend your access to the Application at any time, with or without cause and without prior notice. Sections 6, 7, and 8 of these Terms shall survive any such termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
Any dispute arising from these Terms or the use of the Application shall first be addressed through informal negotiations initiated by contacting legal@spotsight.app. If a resolution is not reached within thirty (30) days, the dispute shall be resolved through binding arbitration in the State of Delaware, administered by the American Arbitration Association (AAA).
YOU AGREE TO WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION OR JURY TRIALS.
We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notifications. Your continued use of the Application after such modifications constitutes your acceptance of the revised Terms.
